1. Acceptance of Terms
By accessing and using PaymentSetu's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms and Conditions, you should not use our services.
2. Description of Services
PaymentSetu provides dynamic QR code generation and payment verification services. We facilitate payment verification by checking bank accounts and matching transactions with generated QR codes. All payments are processed directly through UPI between customers and merchants - we do not process or hold funds.
3. User Accounts and Registration
To use our services, you must:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials, including API keys
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized use of your account
4. Service Usage
You agree to use our services only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the service for any illegal or unauthorized purpose
- Violate any laws in your jurisdiction
- Transmit any worms, viruses, or any code of a destructive nature
- Attempt to gain unauthorized access to our systems or networks
- Use the service to process fraudulent transactions
- Share your API keys with unauthorized parties
5. Subscription and Payment
Our services are offered on a subscription basis. By subscribing, you agree to pay the subscription fees as displayed at the time of purchase. Subscription fees are charged in advance and are non-refundable except as required by law or as specified in our Refund Policy.
6. Service Availability
We strive to ensure our services are available 24/7, but we do not guarantee uninterrupted access. We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice.
7. Intellectual Property
All content, features, and functionality of the PaymentSetu service, including but not limited to text, graphics, logos, icons, and software, are the exclusive property of PaymentSetu and are protected by copyright, trademark, and other intellectual property laws.
8. Limitation of Liability
PaymentSetu shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless PaymentSetu, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the service or violation of these Terms.
10. Termination
We reserve the right to terminate or suspend your account and access to the service immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the service will cease immediately.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or through our service. Your continued use of the service after such modifications constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
